Terms of service

These terms are an agreement between you and Kept (keptplans.com). By creating an account or using Kept, you agree to them. Please read them; we have tried to keep them plain.

1. What Kept is

Kept is a marketplace where people discover and join plans, and where hosts and venues create them. Kept provides the tools: plan pages, holds and payments, check-in, chat, albums and safety features. Hosts and venues run their plans. They are independent, not our employees or agents, and they are responsible for what they offer.

2. Who can use Kept

• You must be 18 or older. Plans marked 21 and over are only for people 21 or older.
• You must give accurate information, including your birth year, and keep it up to date.
• One person, one account. You may not use an account for someone else, or create a new account after we have removed you.
• You are responsible for keeping your login safe and for what happens on your account.

3. Plans, holds and payments

When you join a plan, you authorize a hold on your card for the deposit shown. Holds, cancellations, no-shows, paid plans and refunds work exactly as described in the deposit and refund policy, which is part of these terms.

Card payments are processed by Stripe, and you also agree to Stripe’s terms for those payments. Prices are shown before you commit. Platform fees are shown on the pricing page.

4. Hosting

If you host, you also agree to the host guidelines. You are responsible for describing your plan honestly, having the right to use the place you choose, following local laws and rules, and running the plan safely. Payouts are made after the plan through Stripe, subject to Stripe’s terms and verification. We may hold a payout while we look into a report or a dispute about the plan.

Venues also agree to the venue terms.

6. Subscriptions

Paid tiers renew automatically at the end of each period until you cancel. You can cancel any time in settings. Cancelling stops the next renewal; it does not refund the current period unless the law requires it.

7. How you behave

You agree to follow the community guidelines. You may not use Kept to break the law, harm anyone, send spam, scrape data, get around our systems or security, take payments outside Kept for plans listed on it, or pretend to be someone else.

8. Your content

You own what you post: messages, photos, plan descriptions. You give Kept a non-exclusive, worldwide, royalty-free license to host, show and share that content in order to run the service, for example showing your photos to the people in that plan’s album. The license ends when you delete the content or your account, except for copies other people have already saved or that we must keep by law.

Only post content you have the right to post. Do not post other people’s private information, or photos of people who asked not to be photographed.

9. Risk and safety

Plans involve real activities with real people: sports, outdoor trips, food, alcohol for plans that are 21 and over. Some carry a risk of injury. You choose which plans to join and you are responsible for your own conduct and for judging whether an activity is right for you. We provide safety features and act on reports, but we do not supervise plans and we cannot guarantee how any person will behave.

If you are in danger, call your local emergency number first.

10. Ending your account

You can delete your account at any time. We may suspend or remove accounts that break these terms or the guidelines, or that put others at risk. If we remove your account, any holds on upcoming plans are released, except where the deposit policy says otherwise.

11. Disclaimers

Kept is provided “as is”. We work hard to keep it running and accurate, but we do not promise it will always be available, error free, or that any plan will happen as described. To the extent the law allows, we disclaim all implied warranties.

12. Limitation of liability

To the extent the law allows, Kept is not liable for indirect, incidental or consequential losses, or for the conduct of hosts, venues or other members. Our total liability to you for any claim is limited to the greater of the fees you paid us in the 12 months before the claim, or one hundred US dollars. Nothing in these terms limits liability that cannot be limited by law.

13. Indemnity

If you break these terms or the law, and a claim is made against Kept because of it, you agree to cover the reasonable costs of that claim.

14. Disputes

If something goes wrong, contact us first at support@keptplans.com; most things are sorted out quickly. These terms are governed by the laws of the state where Kept is registered, without regard to conflict of law rules, and disputes will be heard in the courts of that state unless the law where you live gives you the right to bring a claim there.

15. Changes

We may update these terms. If a change is significant, we will tell you by email or in the app before it takes effect. If you keep using Kept after that, the new terms apply.
